Effective January 6, 2020, the new FMCSA Regulation 382.701 requires all DOT Employers to query the FMCSA Drug and Alcohol Clearinghouse (known henceforth as Clearinghouse) on all employees that operate in a Safety Sensitive Position annually. This limited query provides access to information that is available in the Clearinghouse on employed drivers. According to the regulation, employees that do not authorize this review of their Clearinghouse data can no longer operate a commercial vehicle for the company. The information contained in the Drug and Alcohol Clearinghouse is available to each employee by visiting the Clearinghouse at the FMCSA website. It will be the employee’s responsibility to insure any data contained within the Clearinghouse is accurate. The employer will never knowingly report incorrect or inaccurate information to the Clearinghouse.
